News New legal regime for payment services and electronic money 06/12/2018

The new legal regime for payment services and electronic money ("RJSPME") entered into force on November 13th. The Decree-Law - No. 91/2018, of November 12th - transposes into the internal legal order the 2015 Directive / 2366 of the European Parliament and of the Council of 11/25/2015 (second Payment Services Directive) and repeals the previous legal regime for payment services and electronic money, approved by Decree-Law no. 317/2009, of October 30th.
The legal regime now approved generally maintains the discipline in force since 2012, but introduces the necessary amendments to the transposition of the second Payment Services Directive, as well as some improvements to the previous regime and some matters that, not resulting from the transposition of the Directive, are not beyond its discipline juridiction.
Implementing measures are also introduced for three European regulations related to payment transactions within the Union.
