News News Flash - Reinforcement of access to credit and insurance contracts for people who have overcome or mitigated aggravated health risk situations 19/11/2021

The Portuguese Parliament decreed, on November 3, 2021, Decree No. 189/XIV, thus enshrining the right to be forgotten and strengthening access to credit and insurance contracts for people who have overcome or mitigated situations of aggravated health risk or disability, and prohibiting discriminatory practices in this regard.

The new law, already dubbed as “Lei do Esquecimento”, which will shortly be published in Diário da República (Journal of the Republic), arises following the Portuguese Parliament’s decision, of the past October 22, 2021, embodied in the Member’s bill no. 691/XIV/2.

As part of the Member’s bill approval, several entities were requested to provide an opinion, among which we highlight those of the Portuguese Association of Insurers (APS) and the Supervisory Authority of Insurance and Pension Funds (ASF), available at www.parlamento.pt.
